President Claudia Sheinbaum threatens to sue Elon Musk over cartel claim

Mexican President Claudia Sheinbaum has threatened to take legal action against Elon Musk after the billionaire alleged that she is influenced by drug cartels—a claim he made following the killing of CJNG leader Nemesio Oseguera Cervantes, known as El Mencho.

The comments sparked a political storm in Mexico, prompting strong pushback from government officials and the Mexican embassy.


Musk’s Claim and the Triggering Incident

The exchange began when Musk responded to an online post containing a 2025 clip of Sheinbaum discussing why an all-out “war on drugs”—often promoted under the banner of “rule of law”—violates constitutional principles by allowing extrajudicial killings.

A user commented on the video:

“She’s a cartel plant, right?”

Musk replied:

“She’s just saying what her cartel bosses tell her to say.”

He offered no evidence to support the claim and added that disobedience to the cartels carried consequences “worse than a performance improvement plan.”

The video resurfaced shortly after Mexican authorities killed El Mencho, the feared head of the Jalisco New Generation Cartel (CJNG), in a major security operation.


Sheinbaum Pushes Back: ‘Considering Legal Action’

During her daily press conference at Palacio Nacional, Sheinbaum dismissed Musk’s allegation as false and dangerous, saying she is weighing legal action.

She accused Musk of spreading misinformation to millions of users on a platform he owns, remarking that such claims undermine public trust and distort Mexico’s security efforts.


Mexican Embassy: ‘Context Matters’

Mexico’s embassy in the United States condemned the misuse of the old clip, calling it a deliberate attempt to distract from an important counter-cartel victory.

The embassy stated:

“Context matters: the video is an old legal theory clip, while yesterday’s operation was a massive strategic win… Don’t let them spin a victory into a conspiracy.”


Weapons Flow From the U.S., Mexico Says

Mexican Defence Minister Ricardo Trevilla Trejo added a broader geopolitical angle, stating that 80% of the 25,000 weapons seized from cartels since 2024 originated from the United States.

Security analysts say such weapons trafficking continues to fuel cartel violence and complicates bilateral relations.


Could She Sue Musk in the U.S.?

Legal experts note that pursuing civil defamation in the United States will be difficult, as Sheinbaum would need to prove Musk:

  • knowingly made a false statement, or
  • acted with reckless disregard for the truth,

a high legal standard for public figures under U.S. law.
